What Wayne requires before the tenant moves in
Continued Certificate of Occupancy (CCO).
When it applies. Change in tenancy, use or ownership. A CCO is required for both the sale and the rental of covered residential units, and no residential premises may be changed in tenancy without one.
Who handles it. Building Department / CCO Office, Township of Wayne, Town Hall, 475 Valley Road, Wayne NJ 07470; 973-694-1800 x3263. A separate CCO Fire Inspection is handled by the Fire Bureau, 973-694-1800 x3300.
From the ordinance. Township Code Ch. 100 (Residential Certificate of Continued Occupancy). Covers one- or two-family homes, duplexes, townhouses and condominiums, among other residential units. The inspection determines conformance with the Township's Zoning and Property Maintenance ordinances and confirms that additions, attic or basement apartments, finished basements, garages, sheds, pools, second kitchens and decks were built with required permits or under a variance. EXEMPTION: no CCO is required if the change of tenancy, use or ownership is between immediate family members (spouse to spouse, parent to child, or sibling to sibling only). Inspections are not scheduled while open permits exist; once permits are closed the CCO Enforcement Officer has 15 business days to inspect and either issue or explain a failure. Expediting fees apply for inspections needed sooner than 10 days after application. A base application fee is paid online (the Township has posted $100 for the CCO application; confirm the current fee schedule). An issued CCO is valid for 90 days. A separate CCO Fire Inspection is also required.
What that means for your lease start date
The lease start date in Section 2 of the template is the date the tenant is entitled to occupy the unit. In Wayne that date should fall after the certificate or inspection above has been issued, not before it. Schedule the inspection first, then write the start date.
If the certificate slips, the tenant cannot lawfully take occupancy on the day the lease says they can, and you are holding a signed contract you cannot perform. The copy of the lease on this page carries Wayne's requirement as a printed addendum so the person signing it can see the same thing.

When can the lease start in Wayne?
Set the start date after the certificate or inspection is issued, not before. Change in tenancy, use or ownership. A CCO is required for both the sale and the rental of covered residential units, and no residential premises may be changed in tenancy without one. If the certificate is late, the tenant cannot lawfully take occupancy on the date written in the lease, which is the problem this page exists to prevent.
Do I still have to register as a landlord in Wayne?
Yes. Wayne's municipal requirement is on top of, not instead of, New Jersey's statewide Landlord Registration / Identity Law (N.J.S.A. 46:8-27 to 46:8-37). Both apply.
